1. Service and operator

Uselist (the "Service") is operated by Roman Usov, a sole proprietorship (enskild firma) registered in Sweden. Contact: [email protected].

The Service is a hosted inventory and listing tool. Marketplaces (OLX, Allegro, Vinted, Facebook, eBay, etc.) are independent third parties; their terms apply when you publish to them.

2. Billing and subscriptions

Paid plans are billed in EUR via Stripe. For Polish residents, prices include 23% Polish VAT (PTU) handled through the EU One-Stop-Shop (OSS) scheme — no separate Polish VAT registration is required of the operator. Your card issuer's conversion rate applies if your card is denominated in another currency.

Auto-renewal. Monthly and annual subscriptions renew automatically at the end of each billing period at the then-current price for your plan. We do not send a reminder before renewal. You can cancel any time from the dashboard or by contacting support; cancellation takes effect at the end of the current paid period.

Price changes. If we change the price of an existing plan, we will notify affected subscribers by email or in-app at least 30 days before the change takes effect.

3. Right of withdrawal (Ustawa o prawach konsumenta, Art. 27)

You generally have a 14-day right to withdraw from a distance contract under Article 27 of the Polish Act on Consumer Rights (30 May 2014). However, paid subscriptions on Uselist are digital services provided immediately upon purchase. By starting a subscription you give your express consent to performance commencing during the 14-day withdrawal period, and you acknowledge that you will lose the right of withdrawal once performance is complete (Art. 38(13)).

If your subscription has not yet been used at all, you may request a refund of the unused billing period by contacting [email protected] within 14 days of purchase.

You may submit a complaint about the Service by email to [email protected]. We will acknowledge receipt and provide an initial response within 10 business days, and a final response within 30 days, in accordance with the Polish Act on Provision of Services by Electronic Means (18 July 2002).

7. Data protection and GDPR

Personal data handling complies with the GDPR (Regulation (EU) 2016/679) and the Polish Personal Data Protection Act (10 May 2018). Lawful bases: contract for account/billing, legitimate interest for security and abuse prevention, consent for analytics. You may exercise GDPR Article 15–22 rights as set out in our Privacy Policy and lodge a complaint with the President of the Personal Data Protection Office (UODO — uodo.gov.pl).

8. Sub-processors

Core sub-processors (Stripe, Telegram, Google/Gemini, Cloudflare, PostHog Cloud EU, Hetzner, R2) are listed in the Privacy Policy with regions and roles. Cross-border transfers outside the EU/EEA rely on Standard Contractual Clauses and applicable adequacy decisions.

9. Marketplace integrations

OAuth connections to marketplaces (e.g. eBay, Allegro) authorise Uselist to act on your behalf within the granted scope. We never store marketplace passwords; you can revoke at any time. Listings published to marketplaces are governed by that marketplace's terms.

10. Free plan and beta features

Features available without payment ("Free plan") and any features explicitly marked "beta", "preview", or "experimental" are provided "as is" and "as available", without warranties of any kind. We may modify, limit, suspend, or discontinue these features at any time, with or without notice. Paid plans are subject to the modification-notice provisions in section 2. Continued use after changes constitutes acceptance.

11. Liability

Nothing in these Terms limits liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot be excluded under Polish or EU consumer law. For breach of essential contractual obligations (obowiązki istotne) — those whose fulfilment is necessary for the proper performance of these Terms and on whose observance you may regularly rely — our liability is limited to damages that are typical and reasonably foreseeable at the time the contract was concluded. Subject to those carve-outs, our aggregate liability for ordinary negligence in respect of non-essential obligations arising out of or in connection with the Service in any 12-month period is limited to the greater of (a) the fees you paid us in that period or (b) EUR 100. Polish § 385¹ Civil Code on abusive clauses controls — any clause deemed abusive under that section is automatically void.

12. Termination

You may delete your account at any time via the bot's /deleteaccount command. We may terminate or suspend accounts in serious or repeated breach of these Terms; we'll give reasonable notice where the breach is curable.

13. Changes to these Terms

Material changes will be notified by email or in-app at least 30 days before the effective date. Continued use after the effective date is acceptance.
