1. Service and operator
Uselist (the "Service") is operated by Roman Usov, a sole proprietorship (enskild firma) registered in Sweden. Contact for legal and support matters: [email protected].
The Service is a hosted inventory and listing tool: it stores items you describe to it and helps you generate listings for second-hand marketplaces. Marketplaces themselves (Blocket, Tradera, Vinted, eBay, Facebook, etc.) are independent third parties; their terms apply when you publish to them.
2. Billing and subscriptions
Paid plans are billed in EUR via Stripe (per ADR-0026). For Swedish residents, prices include 25% VAT (moms) handled through the EU One-Stop-Shop (OSS) scheme. If your payment method is denominated in another currency, your issuer's conversion rate applies — Uselist does not surcharge for currency conversion.
Auto-renewal. Monthly and annual subscriptions renew automatically at the end of each billing period at the then-current price for your plan. We do not send a reminder before renewal. You can cancel any time from the dashboard or by contacting support; cancellation takes effect at the end of the current paid period.
Price changes. If we change the price of an existing plan, we will notify affected subscribers by email or in-app at least 30 days before the change takes effect. Continued use after the effective date is acceptance.
3. Right of withdrawal (Distansavtalslagen 2005:59)
Paid subscriptions on Uselist are digital services provided immediately upon purchase. By starting a subscription, you acknowledge and agree that we begin performance during the 14-day withdrawal period under Sweden's Distance Contracts Act (2005:59) implementing EU Directive 2011/83/EU.
You waive your right of withdrawal in respect of any portion of the service that has been provided. If your subscription has not yet been used at all, a refund of the unused billing period is available on request to [email protected] within 14 days of purchase.
4. Country legal framework (SE)
- Governing law: Swedish law, specifically the Consumer Services Act (Konsumenttjänstlagen 2022:260), the Distance Contracts Act (2005:59), and the Marketing Act (Marknadsföringslagen 2008:486) where applicable.
- Competent court: Stockholm tingsrätt is the competent court for disputes arising from these Terms, without prejudice to your statutory consumer-court rights.
- Alternative dispute resolution: The National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN — arn.se) provides free advisory dispute resolution. Their decisions are not binding but are widely followed.
- Online Dispute Resolution: The European Commission's ODR platform is available at ec.europa.eu/consumers/odr.
5. Acceptable use
- One account per person. Don't share credentials.
- Don't upload content you don't have the right to use (third-party photos, copyrighted product images you didn't take, illegal items).
- Don't use the Service to generate misleading, fraudulent, or unlawful listings.
- Don't attempt to bypass rate limits, abuse referral mechanics, or scrape other users' data.
- We may suspend or terminate accounts that violate these rules; serious violations may be reported to the relevant marketplace and to law enforcement.
6. Data protection and GDPR
Personal data handling follows the General Data Protection Regulation (GDPR, Regulation (EU) 2016/679) and Sweden's Data Protection Act (Lag 2018:218). Lawful bases for our processing are: contract (Art. 6(1)(b)) for account and billing; legitimate interest (Art. 6(1)(f)) for security, abuse prevention, and product improvement; and consent (Art. 6(1)(a)) for analytics cookies and any future marketing communications.
You have the rights set out in GDPR Articles 15–22 (access, rectification, erasure, restriction, portability, objection, automated decision-making). 7. Sub-processors
Core sub-processors are listed in our Privacy Policy. We use Stripe (payments), Telegram (bot platform and login), Google (AI inference for listings), Cloudflare (CDN, security), PostHog (product analytics, EU-hosted), and a EU-region cloud host (Hetzner / OVH). Cross-border transfers outside the EU/EEA rely on Standard Contractual Clauses and applicable adequacy decisions.
8. Marketplace integrations
Where you connect a marketplace account (e.g. eBay) via OAuth, you authorise Uselist to act on your behalf within the scope you grant. We never store marketplace passwords; we hold short-lived OAuth tokens which you can revoke at any time from the marketplace's own settings or via the bot's /disconnect command.
Listings published to marketplaces are governed by that marketplace's terms. We are not responsible for marketplace decisions to remove, suspend, or restrict your listings.
9. Free plan and beta features
Features available without payment ("Free plan") and any features explicitly marked "beta", "preview", or "experimental" are provided "as is" and "as available", without warranties of any kind. We may modify, limit, suspend, or discontinue these features at any time, with or without notice. Paid plans are subject to the modification-notice provisions in section 2 (Billing and subscriptions). Continued use after changes constitutes acceptance.
10. Liability
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, gross negligence, or any other liability that cannot be excluded under Swedish or EU law. For breach of essential contractual obligations — those whose fulfilment is necessary for the proper performance of these Terms and on whose observance you may regularly rely — our liability is limited to damages that are typical and reasonably foreseeable at the time the contract was concluded. Subject to those carve-outs, our aggregate liability for ordinary negligence in respect of non-essential obligations arising out of or in connection with the Service in any 12-month period is limited to the greater of (a) the fees you paid us in that period or (b) EUR 100.
11. Termination
You may delete your account at any time via the bot's /deleteaccount command. We may terminate or suspend accounts in serious or repeated breach of these Terms; we'll give reasonable notice where the breach is curable. Upon termination, paid plans stop renewing; you can request a refund of the unused billing period as set out in section 3.
12. Changes to these Terms
We may update these Terms to reflect product, legal, or regulatory changes. Material changes will be notified by email or in-app at least 30 days before the effective date. Continued use after the effective date is acceptance. The "Effective date" line at the top of this document tracks the latest version.
